Dear Sir/Madam,

Thank you for your e-mail in relation to applying for skilled migration to
Australia.

From 1 July 2003, the Migration Regulations 1994 for General Skilled
Migration applications specify a period of two years of full-time study
whilst physically in Australia for applicants seeking the work experience
waiver. The relevant provisions expect that applicants simultaneously meet
the combined requirements to have studied full-time and lived in Australia
for no less than two years.

The following table shows in simple terms how to meet the two-year study
requirement.


To meet the two-year full time study component, a conventional two-year
full-time courses will:

¡¤ be registered on the Commonwealth Register of Institutions and
Courses for Overseas Students (CRICOS),

¡¤ involve at least four full semesters* based on the normal semester
length at that institution and,

¡¤ involve a full-time study load undertaken while the student is
physically present in Australia for two years.

* A semester typically equates to a half yearly program of study

Please note the following information on acceptable and unacceptable study
patterns under the new requirements. Please note that this information is
intended as a guide only and represents current policy in effect. Please
check prior to lodging your application for current requirements to ensure
that you are aware of any revised criteria.

Acceptable study patterns

Conventional courses

¡¤ CRICOS registered
¡¤ Course comprises four semesters of approximately equal length.
¡¤ Student undertakes study full time load over the four semesters.

More than one course

It is possible to study more than 1 course in order to meet the 2 year
full-time requirement. The first course must be:

¡¤ CRICOS registered as 78 weeks
¡¤ Course completed in conventional three semesters, meaning total of 18
months full-time study
¡¤ No reduction in normal contact hours

The second course must be:
¡¤ no less than 26 weeks and meets definition of qualification for
migration purposes (degree, diploma or trade qualification ¨C see regulation
2.26A) and
¡¤ relevant to both the first course and the nominated occupation.

Unacceptable study patterns

Elongating 1 year courses

It is not the intention that students be entitled to elongate 52-week
courses to meet the two-year requirement. This is because, generally, a
student would not maintain full-time status over that period.

Compressed courses

¡¤ CRICOS registered as 104 weeks
¡¤ Course comprises four semesters
¡¤ These semesters are completed consecutively within about 18 months
(ie. from February year 1 to June year 2 or from July year 1 to December
year 2.)

While the student has undertaken what is described as a two-year full time
course, the units studied have been compressed into a shorter study period
meaning that the student has not been physically present in Australia for
two actual years as a full time student.

Substantial benefit from credits

¡¤ CRICOS registered
¡¤ Course normally comprises four semesters of full-time study
¡¤ Student relies on 50 per cent of credits/RPL/recognition of work
experience, substantially reducing the contact time and study load.
¡¤ The course is completed over three semesters and within 18 months
